Terms of Service

Effective date: September 21, 2026

1. Agreement to Terms

These Terms of Service (these "Terms") are a binding agreement between you and Byond R Co., Ltd. ("Byond R," "we," "us," or "our"), a company incorporated in the Republic of Korea with its registered office at 201, 6 Gangnam-daero 10-gil, Seocho-gu, Seoul 06787, Republic of Korea. They govern your access to and use of the View R platform, the website at https://viewr.co, and any related applications and services that link to these Terms (together, the "Services").

You accept these Terms by clicking a button or checking a box presented with them (for example, when you create an account). If you do not agree to these Terms, do not create an account or use the Services.

If you use the Services on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization.

Eligibility. The Services are intended for professional and business use. You must be at least 18 years old to use the Services. We do not permit persons under 18 to register or use the Services.

We recommend that you save or print a copy of these Terms for your records.

2. Our Services

View R is a platform for organizing, viewing, and sharing 3D models and related content in an interactive workspace. It supports both extended reality (XR) environments (AR/VR) and standard desktop access, so teams can present, review, and document 3D assets with or without immersive hardware. Typical uses include design reviews, technical documentation, training materials, and collaborative product development.

The Services are not directed to any jurisdiction where their provision would be unlawful. If you access the Services from a location where local law restricts their use, you are responsible for complying with those local laws.

3. Intellectual Property

Our property. We own or license all intellectual property rights in the Services, including software, source code, databases, interfaces, designs, text, and graphics (the "Company Content"), and in our trademarks, service marks, and logos (the "Marks"). Except for the limited rights expressly granted in these Terms, we reserve all rights in the Services, Company Content, and Marks.

Your license to use the Services. Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes (or, if you are an individual user, your own professional use). You may not copy, modify, distribute, sell, lease, or sublicense the Services or Company Content, or use the Marks, except as these Terms allow or as we agree in writing. Requests for other uses can be sent to contact@byond-r.com.

Feedback. If you send us questions, comments, suggestions, or other feedback about the Services ("Feedback"), you grant us the right to use that Feedback, without charge, solely for the purpose of operating and improving the Services, without any obligation to you. Providing Feedback does not transfer ownership of your intellectual property to us. Feedback does not include your Customer Content (Section 5).

4. User Accounts

You sign in to the Services with an email address and password, or through a supported identity provider: Google, Microsoft, or Apple. Passwords are handled by our authentication service and are not stored in our service database.

You are responsible for:

• keeping your password and sign-in credentials secure and not letting others use your account;

• all activity that occurs under your account; and

• ensuring that the profile information associated with your account is accurate and kept up to date.

Notify us promptly at contact@byond-r.com if you believe your account has been accessed without authorization. We may suspend an account when reasonably necessary to protect the Services or other users, and we will notify you of the suspension and its reason unless the law prevents us from doing so.

5. User Content

5.1 What Customer Content is. "Customer Content" means the content you or your organization upload to or create in the Services, including 3D models and assets, CAD and prototype files, textures and related materials, annotations, comments, and workspace configurations, and any personal data contained in them.

5.2 Your ownership; our limited license. You (or your licensors) retain all rights in Customer Content. We claim no ownership of it. You grant us only the license we need to run the Services: a worldwide, non-exclusive license to host, store, back up, reproduce, transmit, display, and technically process Customer Content (including converting file formats and generating renderings or previews) solely to provide, secure, and support the Services for you and the people you share your workspace with, and as otherwise required by law. This license ends when the Customer Content is deleted from the Services, except for copies in routine backups until those backups cycle out, and copies we must retain by law.

5.3 Your responsibilities. You are responsible for your Customer Content. You represent that you have the rights needed to upload it and to grant the license above, and that your Customer Content and your sharing of it do not infringe anyone's intellectual property or other rights or violate applicable law. Except as described in the Privacy Policy (for example, preview images of prototypes imported through the Figma Plugin), Customer Content is visible only to you and the people it is shared with through your workspace settings; you are responsible for those sharing choices.

5.4 Removal. We do not monitor Customer Content as a matter of course. We may remove or disable access to specific Customer Content if we receive a legitimate infringement notice, are required by law, or reasonably determine that the content violates these Terms. Where practicable, we will notify the affected user and give them an opportunity to respond.

5.5 Copyright infringement reports. If you believe content on the Services infringes your copyright, you may report it to us. We handle infringement reports in accordance with applicable law, including Article 103 of the Copyright Act of Korea. Send a notice to contact@byond-r.com including:

1. identification of the copyrighted work claimed to be infringed;

2. identification of the allegedly infringing material and information reasonably sufficient for us to locate it;

3. your name, address, and email address;

4. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;

5. a statement that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and

6. your physical or electronic signature.

On receiving a notice that substantiates the claimed infringement, we will remove or disable access to the identified material and notify the user who posted it. That user may submit a counter-notice with the corresponding information demonstrating their legitimate rights (including, for Korean-law requests, under Article 103(3) of the Copyright Act of Korea); we will handle counter-notices, and restore material where the law requires, in accordance with applicable law. We may terminate the accounts of repeat infringers.

6. Paid Services

The Services do not currently offer self-serve paid plans or in-Service purchases. If we introduce paid features or subscriptions, we will — before you purchase — clearly disclose the price, payment terms, any renewal terms, and the applicable refund and cancellation conditions, and we will obtain your express consent to those terms. Any automatic renewal or free-to-paid conversion will take effect only after that disclosure and consent, and paid offerings to consumers will comply with applicable consumer-protection laws, including withdrawal and refund rights that cannot be waived.

7. Prohibited Uses

You may use the Services only as intended and as permitted by these Terms and applicable law. You agree not to:

• access the Services by unauthorized automated means (bots, scrapers, or scripts), or systematically extract data or content from the Services without our written permission;

• probe, disable, or circumvent security or access-control features of the Services, or attempt to access accounts, workspaces, or data you are not authorized to access;

• upload or transmit malicious code, or take actions that interfere with, disrupt, or place an undue burden on the Services or connected networks;

• reverse engineer, decompile, or disassemble the software comprising the Services, except to the extent applicable law permits despite this restriction;

• impersonate another person or misrepresent your affiliation with any person or organization;

• upload or share content that is unlawful, infringing, defamatory, or harassing, or use the Services to harm others;

• use the Services to build a competing product, or resell or commercially exploit the Services or Company Content without our written agreement;

• remove copyright or other proprietary notices from the Services or Company Content; or

• use the Services in violation of applicable export-control or sanctions laws.

Violation of this section is a material breach of these Terms.

8. Third-Party Services

SSO providers. If you sign in through Google, Microsoft, or Apple (an "SSO provider"), your relationship with that provider — including its handling of your credentials and account data — is governed by that provider's own terms and privacy policy. We never ask you to give us the password to a third-party account. If your SSO provider account becomes unavailable, you may lose access to the Services until sign-in can be restored.

External links. The Services or our communications may link to third-party websites or content. We do not control and are not responsible for third-party sites, and linking to them does not imply our endorsement. Your use of them is at your own risk and subject to their own terms.

9. Privacy

Our Privacy Policy at https://viewr.co/privacy-policy explains what personal data we collect, how we use it, where it is stored, and how it may be transferred across borders, along with your rights and how to exercise them. Data storage locations and international data transfers are governed by the Privacy Policy. Please read it; it is an important part of how the Services operate. If these Terms and the Privacy Policy differ with respect to the processing of personal data, the provision more favorable to you (the data subject) applies.

10. Term, Termination, and Data Export

Term. These Terms apply from the time you accept them until your account is closed.

Termination by you. You may stop using the Services and request closure of your account at any time by contacting contact@byond-r.com or privacy@byond-r.com, or by using any in-Service account-closure feature we provide.

Termination or suspension by us. We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if continued provision would create a serious security or legal risk. Except where immediate action is necessary (for example, to address unlawful content, a security threat, or legal compulsion), we will give you prior notice and a reasonable opportunity to cure the breach.

Data export after termination. After your account is closed or these Terms end, we will make your Customer Content available for export in a commonly used format for 60 days following the effective date of termination. This applies even where we terminated your account under this Section; however, content whose provision is prohibited by applicable law (for example, unlawful content) is excluded from export. After that period, we will delete Customer Content in accordance with the Privacy Policy and our retention schedule, subject to routine backup cycles and legal retention obligations.

Survival. Sections that by their nature should survive termination — including Sections 3, 5.2 (as to the wind-down of the license), 12, 13, and 14 — survive.

11. Changes to the Services and to These Terms

Changes to the Services. We continually improve the Services and may add, modify, or retire features. If a change would materially reduce the core functionality you use, we will give you reasonable prior notice.

Discontinuation of the Services. If we discontinue all or part of the Services for business reasons (such as closing or converting the business), we will announce the discontinuation and its date at least 30 days in advance and notify you individually. In that case we will give you the opportunity to export your Customer Content under Section 10, and, if paid services are being provided at that time, we will take user-protection measures such as refunds in accordance with applicable law.

Changes to these Terms. We may revise these Terms from time to time. If a change is material and adverse to you, we will notify you at least 30 days before it takes effect — by email to your registered address or by prominent in-Service notice — and the notice will state the effective date of the revised Terms. If you do not agree to the revised Terms, you may terminate these Terms and stop using the Services at any time before the effective date, without penalty. For material adverse changes, we will also prompt you to review and expressly accept the revised Terms (for example, by click-through at your next sign-in), and we keep records of the Terms version and time of acceptance. Changes that are not adverse to you (for example, changes required by law or corrections that do not reduce your rights) will be announced at least 7 days before they take effect. Revised Terms apply only from their stated effective date; we will not apply them retroactively.

12. Disclaimers and Limitation of Liability

Disclaimers. The Services are provided "as is" and "as available." To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. This disclaimer does not exclude warranties or guarantees that applicable law does not allow to be excluded.

Your data. You are responsible for maintaining independent copies of Customer Content that is critical to your business, and we encourage you to export important assets regularly. This does not limit our obligations under Section 10, the Privacy Policy, or applicable law.

Limitation of liability. To the fullest extent permitted by applicable law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to the Services or these Terms. To the same extent, our total aggregate liability arising out of or related to the Services or these Terms is limited to the total amount you paid us for the Services in the 12 months immediately preceding the event giving rise to the claim or, if you have paid us nothing in that period, the amount for which we are liable under applicable law.

Exceptions. Nothing in these Terms excludes or limits either party's liability for willful misconduct or gross negligence, for death or personal injury caused by its negligence, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, nothing in this section limits any rights you have under mandatory consumer-protection laws of your jurisdiction.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-laws rules.

Business users. If you use the Services in the course of your trade, business, or profession, you and we agree that the Seoul Central District Court in the Republic of Korea shall be the agreed court of first instance for disputes arising out of or in connection with these Terms.

Consumers. If you use the Services as a consumer, nothing in these Terms deprives you of the protection of mandatory consumer-protection laws of the country or state where you reside, or of your right to bring or defend proceedings in the courts that those laws make available to you. For consumers residing in Korea, jurisdiction is determined in accordance with the Civil Procedure Act and other applicable law.

Before starting formal proceedings, we encourage you to contact us at contact@byond-r.com — most issues can be resolved directly.

14. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and any additional terms we present to you for specific features (which you accept separately), are the entire agreement between you and us regarding the Services. If you have a separately negotiated written agreement with us covering the Services, that agreement controls to the extent it conflicts with these Terms.

Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

No waiver. Our failure to enforce a provision of these Terms is not a waiver of it.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, and will notify you of any such assignment.

Force majeure. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, except for your payment obligations, if any.

Notices. Legal notices to us should be sent to contact@byond-r.com or to our registered address in Section 15. We will send notices to you at the email address associated with your account or through the Services; notices sent this way satisfy any requirement of written notice to the extent the law allows.

No agency. These Terms do not create any partnership, joint venture, employment, or agency relationship between you and us.

Language. These Terms are published in English and in Korean. The two editions are intended to be identical in substance. For users in the Republic of Korea, the Korean edition prevails to the extent of any inconsistency.

Prior versions. From their effective date, these Terms supersede and replace the Terms of Service we previously published (including the English Terms of Service dated 2025-11-03). For users who entered into a service agreement before the effective date, these Terms apply following the amendment process described in Section 11 (notice and individual notification, with the right to terminate without penalty before the effective date).
